Fanalyze Pulse Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Fanalyze Pulse mobile application, website, and related products and services (collectively, the "Service").

The Service is operated by Fanalyze, Inc. ("Fanalyze," "Fanalyze Pulse," the "App," "we," "us," or "our").

By downloading, accessing, purchasing, subscribing to, or using Fanalyze Pulse, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1. Fanalyze Pulse

Fanalyze Pulse is a sports-information and fan-engagement platform that may provide features including:

2. Eligibility

You must be at least 13 years old to use Fanalyze Pulse. Creating an account requires confirming your date of birth; we refuse account creation for anyone under 13.

If you are under the age of majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms where legally required.

You may not use Fanalyze Pulse if applicable law prohibits you from receiving or using the Service.

3. Accounts

Certain features may require a Fanalyze Pulse account. You can create one by signing in with your email address (a one-time code or link is sent to you; there is no password) or with Sign in with Apple where offered. Your account keeps the teams and players you follow, your notification preferences, and your subscription status so they follow you across devices. You can delete your account at any time from Profile.

We may suspend or terminate accounts that violate these Terms, threaten the security or operation of Fanalyze Pulse, or engage in fraudulent or abusive behavior.

4. Sports Information Disclaimer

Fanalyze Pulse provides sports information for informational and entertainment purposes.

Sports information, statistics, sentiment indicators, rankings, predictions, trends, analysis, and AI-generated content may contain errors, delays, omissions, or inaccuracies.

We do not guarantee:

Historical performance does not guarantee future results.

Users should independently verify information that is important to them.

5. Artificial Intelligence

Fanalyze Pulse may use artificial intelligence to generate summaries, classifications, sentiment analysis, explanations, predictions, responses, or other content.

AI-generated content may be inaccurate, incomplete, misleading, or outdated.

You understand that AI outputs are probabilistic and should not be treated as statements of fact solely because Fanalyze Pulse generated them.

Fanalyze does not guarantee the correctness of AI-generated content.

6. No Gambling or Betting Service

Fanalyze Pulse is not a sportsbook, casino, gambling operator, or betting platform.

Fanalyze Pulse does not accept wagers or bets.

Any sports predictions, probabilities, trends, sentiment information, statistics, or analysis presented through the Service are provided solely for informational and entertainment purposes.

Nothing in Fanalyze Pulse constitutes a recommendation or guarantee regarding a wager or gambling decision.

Users are solely responsible for complying with laws applicable to them.

Do not use Fanalyze Pulse as your sole basis for financial or wagering decisions.

7. Fan Sentiment

Fanalyze Pulse may analyze publicly available, licensed, or third-party sports conversations and information to estimate aggregate fan sentiment.

Fan sentiment is an analytical estimate and does not necessarily represent:

Sentiment may be influenced by the availability, quality, geographic distribution, demographics, or volume of underlying data.

Fanalyze Pulse may modify its sentiment methodology over time.

8. Third-Party Content and Data

Fanalyze Pulse may incorporate or analyze information supplied by sports-data providers, social platforms, public sources, APIs, licensors, or other third parties.

Third-party content remains the property of its respective owners.

Fanalyze does not claim ownership over third-party trademarks, team names, player names, social posts, statistics, images, or other third-party intellectual property except where Fanalyze independently owns applicable rights.

Third-party data may be delayed, corrected, removed, unavailable, or subject to third-party restrictions.

9. NFL Disclaimer

Fanalyze Pulse is an independent product.

Unless expressly stated otherwise, Fanalyze and Fanalyze Pulse are not affiliated with, sponsored by, approved by, endorsed by, or officially connected with the National Football League, its member clubs, or their respective affiliates.

NFL, team, player, league, and other names and trademarks belong to their respective owners.

10. Subscriptions and Premium Features

Fanalyze Pulse may offer paid subscriptions, passes, consumable products, or other premium features.

Available products, prices, subscription periods, and promotional offers may change.

Purchases made through Apple App Store or Google Play are subject to the applicable store's payment and subscription terms.

Automatic Renewal. If you purchase an automatically renewing subscription, your subscription will continue and the applicable store will charge the applicable payment method unless you cancel before the renewal deadline established by that store.

Cancellation. You can generally manage or cancel an App Store or Google Play subscription through the subscription settings associated with your applicable store account. Deleting Fanalyze Pulse does not automatically cancel an active subscription. Deleting your Fanalyze Pulse account also does not necessarily cancel an active store subscription.

Free Trials. If a subscription includes a free or discounted trial, your subscription may automatically convert to a paid subscription at the end of the trial unless cancelled within the period required by the applicable app store. Eligibility for promotional trials may be determined by the applicable platform.

Refunds. Purchases processed by Apple or Google are generally subject to that platform's applicable refund policies. Fanalyze may not be able to directly issue refunds for transactions controlled by an app-store provider.

11. RevenueCat

Fanalyze Pulse may use RevenueCat or similar technology to manage purchases, subscription entitlements, trials, and premium access.

RevenueCat does not replace the payment-processing and subscription rules applicable to the platform where your purchase was made.

12. Notifications

If you enable notifications, Fanalyze Pulse may send messages relating to:

Notifications may be delayed, incomplete, duplicated, or fail to arrive.

You should not rely on Fanalyze Pulse notifications as a guaranteed real-time alerting service.

You may disable push notifications through your device settings.

13. User Content

If Fanalyze Pulse allows you to submit prompts, comments, feedback, posts, images, messages, or other materials ("User Content"), you retain any ownership rights you otherwise have in that content.

You grant Fanalyze a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify, and display User Content as reasonably necessary to provide, operate, improve, secure, and support Fanalyze Pulse.

You represent that you have the necessary rights to submit your User Content.

15. Intellectual Property

Fanalyze Pulse, Fanalyze, Fanalyze-created software, interfaces, designs, graphics, animations, AI systems, databases, compilations, algorithms, branding, and original content are owned by Fanalyze or its licensors and are protected by applicable intellectual-property laws.

These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use Fanalyze Pulse for its intended purpose.

No ownership rights are transferred to you.

16. Feedback

If you provide suggestions, ideas, feature requests, or other feedback regarding Fanalyze Pulse, you grant Fanalyze permission to use that feedback without restriction or compensation to you.

17. Third-Party Services

Fanalyze Pulse may contain links to or integrate with services operated by third parties.

Fanalyze does not control those services and is not responsible for their content, availability, security, policies, or practices.

Your use of a third-party service may be governed by separate terms and privacy policies.

18. Service Availability

We may modify, suspend, discontinue, or restrict some or all of Fanalyze Pulse at any time.

We do not guarantee uninterrupted availability.

Live sports and social-information features may be affected by third-party data outages, API limitations, licensing restrictions, internet connectivity, platform changes, or circumstances outside Fanalyze's control.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAN PULSE IS PROVIDED "AS IS" AND "AS AVAILABLE."

FANALYZE DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY OTHER WARRANTIES THAT MAY OTHERWISE APPLY.

WE DO NOT WARRANT THAT:

Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FANALYZE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO FAN PULSE.

THIS INCLUDES LOSS ARISING FROM RELIANCE ON SPORTS INFORMATION, PREDICTIONS, AI OUTPUTS, SENTIMENT DATA, NOTIFICATIONS, OR THIRD-PARTY INFORMATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANALYZE'S AGGREGATE LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID FANALYZE THROUGH FAN PULSE DURING THE 12 MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain liability limitations, so these limitations may not fully apply to you.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold Fanalyze and its affiliates harmless from claims, losses, damages, and expenses arising from your unlawful use of Fanalyze Pulse, your violation of these Terms, or your infringement of another party's rights.

22. Suspension and Termination

You may stop using Fanalyze Pulse at any time.

We may suspend or terminate access if we reasonably determine that you:

23. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

24. App Store Terms

If you downloaded Fanalyze Pulse through the Apple App Store, you acknowledge that these Terms are between you and Fanalyze, not Apple.

Apple is not responsible for Fanalyze Pulse or its content except to the extent required by applicable law or Apple's applicable terms.

Your use of Fanalyze Pulse must also comply with applicable App Store terms.

If you downloaded Fanalyze Pulse through Google Play or another distribution platform, your use of Fanalyze Pulse must also comply with that platform's applicable terms.

25. Changes to These Terms

We may update these Terms periodically.

If changes are material, we may notify users through Fanalyze Pulse, email, or another appropriate method.

Continued use of Fanalyze Pulse after updated Terms become effective constitutes acceptance where permitted by law.

26. Entire Agreement

These Terms and the Fanalyze Pulse Privacy Policy constitute the agreement between you and Fanalyze regarding the Service, except where additional terms expressly apply.

If any provision is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

Our failure to enforce a provision does not waive our right to enforce it later.
